General Terms and Conditions (GTC) — Coffee Space GmbH

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts concluded between the Coffee Space GmbH, Wellenried 2, 3150 Schwarzenburg, Switzerland (hereinafter "Coffee Space"), and its customers (hereinafter "Customer") via the online shop at www.coffeespace.ch and through all other sales channels (e.g. Coffee Space-Ship, Coffee Box).

Deviating conditions of the customer are not recognized, unless Coffee Space has expressly agreed to their validity in writing.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. The Customer submits a binding offer to purchase the products in the shopping cart by sending the order.

The contract is concluded as soon as Coffee Space confirms the order by email (order confirmation). The automatic confirmation of receipt after sending the order does not yet constitute acceptance.

Coffee Space reserves the right to refuse orders without stating reasons, especially in cases of unavailability, suspicion of abuse, or incorrect pricing. In this case, the customer will be informed immediately and any payments made will be refunded.

3. Prices and Payment Terms
3.1 Prices

All prices are in Swiss Francs (CHF) including the statutory value-added tax (currently 8.1 %). The VAT will be itemized separately on the invoice.

Coffee Space reserves the right to change prices at any time. For already confirmed orders, the price valid at the time of ordering applies.

3.2 Shipping Costs

Shipping costs will be itemized separately during the ordering process and are to be borne by the customer. The amount depends on the chosen shipping method and the order value.

3.3 Payment Methods

The following payment methods are available:

  • Credit Card (Visa, Mastercard) — processed via Stripe

  • Prepayment (Bank transfer)

On-site (Coffee Space-Ship, Coffee Box, Events) we also accept:

  • SumUp (Credit card, Debit card, TWINT)

  • Cash payment

Payment processing is done through our payment service providers Stripe, Inc. and SumUp Ltd. Coffee Space does not store any complete credit card information.

3.4 Payment Default

In case of payment default, Coffee Space is entitled to charge default interest of 5% p.a. as well as reminder fees of CHF 20.– per reminder. After the second unsuccessful reminder, Coffee Space reserves the right to assign the claim to a collection agency.

4. Delivery
4.1 Delivery Area

Coffee Space delivers to Switzerland and the Principality of Liechtenstein. Deliveries abroad are possible upon request.

4.2 Delivery Times

Delivery takes place within 2–5 working days after receipt of payment (in advance) or after order confirmation (for credit card/TWINT). The delivery period begins on the day after the order confirmation.

If a product is exceptionally not available, the customer will be informed immediately. Any payments made will be refunded in this case.

4.3 Shipping

Shipping is done via the Swiss Post. The goods will be shipped to the delivery address provided by the customer. The customer is responsible for the accuracy of the delivery address.

4.4 Delivery Delay

In case of a delivery delay of more than 14 days, the customer has the right to set Coffee Space a reasonable extension of at least 7 days. After the unsuccessful expiration of the extension, the customer is entitled to withdraw from the contract.

5. Voluntary Right of Return

Coffee Space grants its customers voluntarily a right of return — beyond the legal provisions:

  • The customer can return the goods within 14 days return without stating reasons after receipt.

  • The return must be in original packaging, unopened and unused. Opened coffee packages are excluded from return for hygienic and quality reasons.

  • The return shipping costs are borne by the customer.

  • The refund of the purchase price will be made within 14 days after receipt and inspection of the returned goods to the original payment method used.

Note: Unlike in the EU, there is no legal right of withdrawal for online purchases in Switzerland. The present return policy is a voluntary service from Coffee Space.

6. Warranty and Complaints
6.1 Legal Warranty

Coffee Space is liable for defects in the goods according to legal regulations (Art. 197 et seq. OR). The legal warranty period is 2 years from delivery.

6.2 Complaints

The customer is obliged to inspect the goods immediately upon receipt. Obvious defects (wrong goods, damaged packaging, transport damage) must be reported in writing within 7 days after receipt (by email to [email protected]) be reported. Hidden defects must be reported immediately upon discovery.

6.3 Remedy of Defects

In the case of a justified defect, the customer is entitled to choose from Coffee Space:

  • Replacement delivery (free replacement of the defective goods)

  • Price reduction (appropriate reduction of the purchase price)

  • Refund (reimbursement of the purchase price against return of the goods)

Coffee Space bears the return shipping costs for defective goods.

7. Limitation of liability

Coffee Space is liable for damages resulting from the violation of life, body, and health, which are based on an intentional or negligent breach of duty by Coffee Space, its legal representatives, or agents, according to the statutory provisions.

For other damages, Coffee Space is liable — to the extent permitted by law — only in case of intentional or grossly negligent conduct. Liability for slight negligence is excluded.

Coffee Space is not liable for damages caused by force majeure, natural events, official orders, or the actions of third parties.

8. Retention of title

The delivered goods remain the property of full payment of all claims arising from the business relationship until paid in full. In case of payment default, Coffee Space is entitled to withdraw from the contract and reclaim the goods at the customer's expense. The customer is obliged to handle the goods subject to retention of title with care and to grant access to the goods upon request by Coffee Space.

9. Data protection

Coffee Space collects and processes personal data exclusively within the framework of the legal provisions, in particular the revised Swiss Data Protection Act (revDSG). The complete privacy policy is available at www.coffeespace.ch/datenschutz accessible.

10. Final Provisions
10.1 Severability Clause

If individual provisions of these terms and conditions are or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.

10.2 Amendments

Coffee Space reserves the right to change these terms and conditions at any time. For ongoing contracts, the version valid at the time of the conclusion of the contract applies. The current version is always available on the website.

10.3 Applicable Law and Jurisdiction

For all legal relationships between Coffee Space and the customer, only Swiss law applies, excluding the UN Sales Convention (CISG).

The place of jurisdiction is Bern, Switzerland. For consumers, the statutory place of jurisdiction applies.
